A 501(c)(6) organization can facilitate deals and charge fees, but earning commissions like a broker is a gray areaand must be handled very carefully.
✅ What a 501(c)(6) can do:
Act as a connector or facilitator between members or between members and external parties.
Charge fees for services, event sponsorships, or introductions, as long as it supports the mission (promoting business interests).
Offer business promotion or networking opportunities as part of membership or service tiers.
⚠️ But it must not:
Primarily exist to generate profit or enrich individuals.
Function as a commercial broker or sales agent, especially if it:
Acts on behalf of one party in a transaction.
Takes a cut or commission directly tied to a completed deal (this can be seen as private benefit).
🧠 Safer Alternatives:
If you want to incentivize business collaboration:
Use flat service fees for deal facilitation, intros, or joint ventures.
Create “business development packages” as part of membership levels.
Offer a sponsorship model: businesses contribute for visibility, leads, or preferred access — not as a per-deal commission.
If you're looking for more flexibility (like brokering with commission), you might:
Set up a for-profit arm or LLC owned by the 501(c)(6).
Or create a hybrid structure where the nonprofit focuses on convening/networking and the for-profit handles transactional services.
